Job Title: 1. Data Protection Officer

Main Purpose of the Job:
Reporting to the Chief Executive Officer, the Data Protection Officer will administer the Data Protection Act and carry out the due diligence processes to ensure adherence to the Act. To ensure that the Commission processes the personal data of its staff, customers, providers or any other individuals (also referred to as data subjects) in compliance with the applicable data protection Laws. The incumbent shall furthermore inform and advise on Data Protection obligations, frameworks, systems, policies, strategies, procedures and processes for the Commission.

Key Responsibilities

  • Develops, implements, and continually enhances data protection policies, procedures, and frameworks in line with the Data Protection Act, providing expert guidance to ensure regulatory compliance and alignment with applicable data protection requirements.
  • Maintains an information disclosure log and a comprehensive inventory of data categories and their usage.
  • Monitors data processing activities and tracks compliance with internal policies and statutory data protection requirements.
  • Conducts routine audits to ensure adherence to data protection regulations and verifies legal conformity in the handling of personal data.
  • Coordinates secure data storage, access, and transmission mechanisms while maintaining centralised data inventories and processing records.
  • Ensures the protection of the rights and freedoms of data subjects in accordance with the Data Protection Act.
  • Conducts periodic Data Protection Impact Assessments (DPIAs) to identify compliance risks in data processing, implements mitigation measures, and continuously monitors risk levels.
  • Acts as liaison between the Commission, regulatory bodies, and data protection authorities and informs and advises data controllers/processors of statutory obligations.
  • Provides expert input on data protection clauses in contracts and third-party engagements and responds to information requests and prepares compliance reports for leadership and regulators.
  • Designs and delivers data protection training and awareness programs, ensures staff understand their legal obligations, and keeps the organisation informed of changes in laws and their implications.
  • Manages data breaches by leading investigations, recommending corrective measures, ensuring timely reporting to authorities, and developing and updating incident response procedures.

Requirements

  • Degree in Law/ Data Science/Information Technology/ Enterprise Risk Management, Project Management or any other related field from a reputable Institution.
  • At least four years work experience in a legislative compliance business environment handling personal data/data compliance/security of data/data processing or related field with in-depth knowledge of data protection laws and practices, including the Botswana Data Protection Act and international best practices.
  • Data Protection and/or Privacy Certifications such as CIPM, CIPP will be an added advantage.
  • Membership of International Association of Privacy Professionals (IAPP) or relevant professional body will be an added advantage.
