In-House Counsel – New Era College of Arts, Science & Technology

Job Summary

The In-house Counsel will be responsible for the effective management of the Legal and Compliance Office at New Era College. The In-house Counsel should be a practicing lawyer and an active member of the Law Society of Botswana. The In-house Counsel will provide comprehensive, trusted legal advice and support on all legal matters, including regulatory compliance and governance, strategy, legal risks and opportunities, policies, and business ethics. Furthermore, the In-house Counsel will be responsible for managing and implementing the Risk Policy and minimizing exposure to risk across all aspects of the organization.

Core Responsibilities

• Advise on all legal, constitutional, and contract matters.
• Lead on all regulatory compliance accreditation and risk management issues.
• Draft, review, and negotiate all agreements, including employment contracts, service agreements, partner and vendor agreements, and licensing agreements.
• Review key legal communications and messages.
• Oversee and manage external counsels and other legal advisors.
• Hire, train, and lead Legal and Compliance team.
• Represent and defend the institution in all legal matters and court proceedings and provide support to external counsel and other legal advisors in all legal and court matters.
• Provide the Executive Management with advice and guidance concerning laws impacting on College’s functions and operations.
• Work closely with key stakeholders including Human Resources, Quality Assurance, Business Development, Marketing and Communication and Council Secretariat on all legal, business and compliance matters.
• Carry out legal research, remain informed, and oversee the development, revision and compliance of the College with all regulatory, agencies or authorities.
• Monitor and revise legal documents, contracts, and policies in response to external changes in policy and the law.
• Initiate investigations of non-compliance taking place within the College.
• Complete all other legal and compliance work as assigned by the Management.

Minimum Requirements

Qualifications:

• LL. B or J.D or equivalent degree in Law
• A Master’s in Corporate or Commercial Law shall be an added advantage

Professional Experience:

• Minimum 4 years work experience at a reputable organization – preferably having held same or similar job roles.
